DESCRIPTION OF SERVICES
greenHDcameras is a high definition digital camera rental company that provides its customers with a high-quality and economical “green”product for capturing event photos and videos.
In our commitment to excellent customer service, we process orders promptly and deliver an email confirmation and order summary within one business day of order placement. We strive to respond to all customer emails and phone calls within 2 business days.
DAMAGE WAIVER/THEFT
greenHDcameras realizes that digital cameras or other equipment may occasionally be damaged during rental use. We offer customers the option to purchase a “Damage Waiver”, which exempts them from financial liability as detailed in the waiver. Customers who have not purchased the Damage Waiver will be held responsible for all expenses relating to the repair or replacement of the equipment, whichever is less. All camera equipment must be returned in order to qualify for the terms stated in the Damage Waiver.
In the event that the camera or other equipment is stolen or otherwise not returned, the renting party will be responsible for expenses relating to the replacement of the missing equipment. (See FAQ’s for replacement fees). The equipment will be deemed not returned after ten (10) business days have lapsed following the conclusion of the rental period.
Because our business is a rental business, our equipment must be returned in a timely manner. A late fee of $5.00 per day, per camera, will be charged each day following the rental period until day ten (10). After day ten (10), the equipment will be deemed NOT returned, so as to require payment of the replacement fee mentioned above.
CAMERA FUNCTION, QUALITY, DELIVERY AND RETURNS
We carefully check all camera equipment, prior to shipment, to ensure that it is in top condition. Should a camera not function properly despite being used as indicated, we will refund you the original rental price. Example: If you rent 20 cameras and 1 of those cameras does not work properly we will reimburse you for the camera at your camera rental rate. In this example the refund would be $31.95.
We provide you high quality and easy-to-use equipment and with each rental we share tips to help you take the best photos and videos. We are not responsible for the final quality of the photos that you and your guests produce.
We will provide your digital cameras and equipment at least one business day prior to your event. Should you wish for earlier delivery, you may request this on the order form. If your equipment has not arrived the day before your event, we will overnight a replacement order to you.
The standard rental period extends two (2) business days following the scheduled event. As outlined above, late fees will begin to accrue on the third business day following the event, and after ten (10) business days have passed, full replacement fees will be charged. Extension of this rental period may be requested on the order page when you place the initial order, or you may contact us online. In case of emergency, please call (317) 408-2493.
OBTAINING YOUR PHOTOS & VIDEOS
After the return of all digital cameras and equipment, greenHDcameras will upload all photos and videos to our website within three to five days. This will include any of your guest’s pictures and videos as long as they are able to be uploaded, as arranged.
We are sensitive that you might not want all photos or videos to be submitted for public display on our website. To accommodate your right to privacy, greenHDcameras offers the renting party the option to review all the photos and videos prior to their general release. No illegal or immoral photos will be included on this website.
All renting parties will be mailed one (1) complimentary complete CD/DVD of their event. Customers may purchase additional copies for a set fee, outlined in the Frequently Asked Questions page.
Any individuals interested in ordering photos, videos, memory books, calendars, CD’s, DVD’s, or other souvenir products from our website may make their selections and proceed to the checkout managed by Smugmug.
All downloaded content will be kept online for a minimum of ninety (90) days. You may make requests for extensions through the website.
CANCELLATIONS AND REFUNDS
There is a $75.00 refundable deposit required to reserve cameras and equipment in quantities less than forty (40). If more than forty (40) cameras are rented, we require that you make a 10% refundable deposit at the time of the order.
Cancellations should be made as soon as possible. Full refunds are granted if you make the request more than thirty (30) days prior to the scheduled event. No requests for refunds will be granted less than thirty (30) days prior to the scheduled event.
The full balance will be charged to the renting party at the time of shipping.
EXPORT RESTRICTIONS
greenHDcameras does not export outside the United States.
PAYMENTS
Because security of personal and financial information is so important to us, we have selected PayPal as our payment processing vendor. PayPal allows payment directly from your PayPal balance, linked bank account, or major credit cards. The PayPal security is through the Website Payments Standard which is PCI DSS Compliant and is SAS70 certified. They also maintain a fraud protection mechanism.
TRANSACTIONS
Renting parties are encouraged to retain a copy of all transactions for their own records.
TERMINATION
If you create possible legal exposure for us, we can stop providing all or any part of our services to you. We will generally try to notify you, but have no obligation to do so. You may also delete your account or disable the images for your event at any time.
DISPUTES
1. You will resolve any claim, cause of action or dispute (“claim”) you have with us arising out of or relating to the rental of cameras to you, the use of the web site, or any other services provided to you in a state or federal court located in Hamilton County, Indiana. The laws of the State of Indiana will govern any claim that might arise between you and greenHDcameras, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Hamilton County, Indiana for the purpose of litigating all such claims.
2. If anyone brings a claim against us related to your actions or your content on greenHDcameras, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.
3. WE TRY TO SUPPLY RENTAL CAMERAS TO YOU IN GOOD CONDITION, AND TO KEEP GREENHDCAMERAS WEB SITE UP, BUG-FREE, AND SAFE, BUT YOU USE THE WEB SITE AT YOUR OWN RISK. WE ARE PROVIDING ALL SERVICES, PRODUCTS, RENTALS AND WEB SITE “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE WEB SITE WILL BE SAFE OR SECURE. GREENHDCAMERAS IS NOT RESPONSIBLE FOR THE ACTIONS OR CONTENT OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. WE WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE RENTAL OF CAMERAS TO YOU, AND THE WEB SITE GREENHDCAMERAS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF THE RENTAL OF CAMERAS TO YOU, THE WEB SITE AND CONTENT PROVIDED BY GREENHDCAMERAS, THE PRIVACY POLICY, OR FOR ANY SERVICE PROVIDED TO YOU, WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH CASES, GREENHDCAMERAS’S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
